End-User License Agreement

THIS PRODUCT IS PROTECTED BY INTELLECTUAL PROPERTY AND COPYRIGHT LAWS. IF YOU USE THIS PRODUCT IN VIOLATION OF THIS END-USER LICENSE AGREEMENT YOU MAY BE SUBJECT TO SEVERE CIVIL AND CRIMINAL PENALITIES AND MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

Important – Read Carefully: This License Agreement is a legal agreement between you an individual person qualified to use the Product as set forth herein, who will be referred to in this License Agreement as “You” and GenCorp Consulting/Quill Driver Books for the product that accompanies this License Agreement, including any associated media, printed materials and electronic documentation. The Product also includes any updates, add-on components, services, and/or supplements that may be provided to You or made available to You after the date You obtain Your initial copy of the Product to the extent that such items are not accompanied by a separate license agreement of terms of use.

By clicking on the Accept button following the electronic version of this License Agreement, installing, copying, downloading or otherwise using the Product, You agree to be bound by the terms of this License Agreement. If You do not agree to the terms of this License Agreement, do not install, access, download or use the Product. Please print a paper version of this License Agreement for Your records, as once You have accepted the electronic version You will no longer be able to electronically access the electronic version of the License Agreement.

PRODUCT LICENSE

The Product is protected by intellectual property laws and treaties. The Product is licensed, not sold.

Grant of License. This section of the License Agreement describes Your general rights to download and use the Product.

You may download and install one copy of the Product per user on a single computer, device, workstation, terminal, or other digital electronic or analog device (“Device”). A license for this Product may not be shared or installed on a shared drive or Device. The Product is only licensed for the intended use outlined in the Product Instruction Sheet.

Reservation of Rights. All rights not expressly granted herein are reserved by GenCorp Consulting/Quill Driver Books.

DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

If You are not qualified as a User you have no rights under this License Agreement and are not authorized or licensed to use this Product. If You are a qualified User, you may not use the Product or make copies of it except as permitted in this License Agreement.

Copy Protection. This Product may include copy protection technology to prevent unauthorized copying of the Product. It is illegal to make unauthorized copies of the Product or to circumvent any copy protection technology included in the Product.

Limitations on Translation, Reverse Engineering, Decompilation, Disassembly. You may not translate, reverse engineer, decompile or disassemble the Product.

Separation of Component Parts. The Product is licensed as a single product. Its component parts may not be separated for use on more than one Device. You may not modify the Product or merge all or any part of the Product with another program.

Trademarks. This License Agreement does not grant You any rights in connection with trademarks or service marks of GenCorp Consulting/Quill Driver Books.

Product Transfer. You may not rent, lease or transfer this License Agreement, any rights hereunder, the Product or any of its components. Any attempted transfer shall be void.

Termination. This license shall remain in effect only for so long as you are in compliance with the terms and conditions of this agreement. This license will terminate if you fail to comply with any of its terms or conditions. You agree, upon termination, to destroy all copies of the Product. The Limitations of Warranties and Liability set out below shall continue in force even after any termination.

INTELLECTUAL PROPERTY RIGHTS. All title and intellectual property rights in and to the Product, any accompanying printed materials and any copies of the Product are owned by GenCorp Consulting/Quill Driver Books. All title and intellectual property rights in and to the content that is not contained in the Product but may be accessed or referenced through the use of the Product, is the property of the respective content owners and may be protected by applicable copyright or other intellectual property laws and treaties. This License Agreement grants You no rights to use such content.

LIMITATION OF WARRANTIES AND LIABILITY:
THE PRODUCT IS PROVIDED ON AN “AS IS” BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCT IS ASSUMED BY YOU. NEITHER WE NOR OUR DEALERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR THEY ARE FORESEEABLE. WE ARE ALSO NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. OUR MAXIMUM AGGREGATE LIABILITY TO YOU AND THAT OF OUR DEALERS AND SUPPLIERS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT. THE LIMITATIONS IN THIS SECTION SHALL APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH. SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
